Can an employeer put a payroll deposit in your account then withdraw it?

My boss direct deposited my pay check then withdrew it or canceled it. They then gave me a paper check but they did not notify me of any of this. Is there anything that I can do becuase that caused me to bounce checks. Are there any laws that prohibit this what can I do about it? Any links to info about this in GA would be greatly appreciated.

There is no law for that. An employer can withdraw funds from your checking account if deposited


in error. They can also replace it with a check if they want to. What you have is a payroll department that should communicate better but no a crime. Sorry.
Reply:They can't withdraw it once they've deposited it, but they might be able to cancel the payment before the payment is settled.





Not much you can do about it unless your bank statement clearly shows that the bank paid it out as a check - then you'd have to go after the bank for an unauthorized withdrawl.

once they got the money out from your bank, it means they have your account number and all other personal stuff that they can also get the money from your savings!!

Reply:Most likely he canceled it. Only you can withdraw from your own account. I can see some legal steps you can follow. There is the lawyer avenue specially if it caused you to default in your payments and were penalized for it. You can explain in a nice manner to your boss and hope that he has one hell of a good reason for what happened and is willing to make amends. Also the bank or credit union should be made responsible for not notifying you. It not only puts you in bad with the lenders but also your credit record suffers. Good luck
Reply:Depositing to your payroll is a prerogative of your boss since it was he/she who did that in the first place...on the other hand, your boss cannot withdraw from your account unless you can give an authorization to do so...if your boss doesn't have this authority, all he or she can do is to debit back the amount deposited to your account and credit it back to his/her account...There are no laws governing this...he or she can do that but if it happens that you were able to withdraw the money from your account, then you will get it at no problem.. but it so happened that your boss was quick enough to do this ahead of you so tough luck on your side...hope this helps...

It wouldn't make sense to me if that was legal to withdraw money.


However, I would think that they can cancel a pending transaction. So if the money hasn't been fully transferred then it can be taken away... Unfortunatly!!!

Reply:Being as though we live in the wonderful right to work state of GA, they may have some right to do this...I would talk to your bank and see if they can offer you any options. Sometimes if my direct deposit doesn't go through, they give me a check because the system doesn't work that week?
